There have been recent changes to the law in relation to legal aid for Special Guardianship Orders.

The Local Authority can apply for a Secure Accommodation Order (SAO) in relation to a child where the child has a history of absconding, is likely to abscond, and, if they do abscond, is likely to suffer significant harm or if they are kept in any other description of the accommodation, they are likely to injure themselves or other persons. Once this criteria is met, the court shall make the order.

If your child has been placed in Local authority foster care, the Local Authority have a duty to promote contact with parents under Section 34(1) Children Act 1989.

A Child Protection Conference is arranged when the Local Authority believes a child is at risk of significant harm. This conference will involve family members and professionals involved with the family. 

Whatever your situation, we will look towards advising and aiding you in making necessary arrangements. Perhaps your situation is one whereby you have separated from your child’s parent and child arrangements need organising. 

During public law proceedings concerning a child, the social worker will carry out a parenting assessment to determine whether it is in the child’s best interests to remain with or return to the care of one or both parents.

When public law proceedings are issued in relation to a child a Children’s Guardian will be appointed. This is somebody who will act on behalf of the child and the Guardian will have their own solicitor.
