Legal Aid funding for Special Guardianship Orders

There have been recent changes to the law in relation to legal aid for Special Guardianship Orders.

A Special Guardianship Order appoints a person or persons as a child’s Special Guardian and provides the Special Guardian with enhanced parental responsibility for the child.

Legal aid is now available to prospective guardians making an application for a Special Guardianship Order in private law proceedings and to anyone with parental responsibility who is the respondent in an application for a Special Guardianship Order.  

Legal Aid for Special Guardianship Orders is means tested which means that the applicant’s financial circumstances must be taken into account.
