Enduring Powers of Attorney

This is a simple but powerful document that allows you to decide who will manage your affairs in the event that you cannot. Anyone with anything should have one.
If you suffer mental incapacity it would then be too late to take this simple but effective step. Should you became incapable and do not have an EPA then your relatives would have to involve a government department, pay high fees and would suffer frustrating delays for permission to deal with the simplest matters on your behalf. With an EPA, people of your choice could deal with your affairs with no fees to pay to the government.

EPAs are only available until April next year when they are being replaced by ‘Lasting Powers of Attorney’ (LPA). New rules will apply, including compulsory registration, a government fee and higher legal costs. These rules do not apply to existing EPAs,

When a person has become incapable of dealing with his or her affairs it is too late for that person to give someone else authority to act for him or her. So often there are just the ordinary things to attend to; draw money from a bank account to pay bills. Many people own property. Any dealing with that property, once a person has become incapable, will involve an application to the Court of Protection to appoint a Receiver.

Completion of an Enduring Power of Attorney can be a means of avoiding considerable difficulties if you become incapable of dealing with your property, and/or investments and/or income. If you appoint an attorney by way of an Enduring Power of Attorney it would not then become necessary to make an application, with the attendant delays and expense, to the Court of Protection for the appointment of a Receiver to manage your affairs. Inevitably fees have to be paid to the Court of Protection and the legal costs associated with such an application are considerably greater than those to complete an Enduring Power of Attorney.

The cost of a Power of Attorney is £85.00 plus VAT. If a home visit is necessary we are pleased to assist but will, as you would expect, raise an extra charge.
